RE: The tariff classification of a Carousel from China

Dear Ms. Hiltpold:

In your letter dated May 17, 2012 you requested a tariff classification ruling.

The carousel in question is designed for use in a CribMaster Pro-Stock 560 dispensing machine. The base material of the carousel is said to be plastic. Removable dividers provide the carousel with the flexibility of being re-configured to allow multi-size items to be stored and dispensed. To retrieve an item, the user first scans his badge and then selects an item using a touch screen. The dispensing machine does not incorporate a payment mechanism. The carousel spins until the compartment where the desired item is stored aligns with the access door. The user manually slides the Pro-Stock 560’s access door open, removes the item from the pie size slot and then manually slides the door shut.

The applicable subheading for the carousel will be 8479.90.9496, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Machines and mechanical appliances having individual functions, not specified or included elsewhere in this chapter; parts thereof: Parts: Other: Other: Other. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
